I agree Brian, U.C. I am confident that Thomas, Scalia, Roberts, and Alito will rule in favor of individual gun rights. I am also confident that Ginsburg and Breyer will take the “collective right” view. As best as I can tell, Souter, Stevens, and Kennedy are the wildcards which the decision will depend. I could imagine that at least one of the three will rule with the individual right view but I wouldn’t count on it.

This illustrates that elections do have consequences. As much as we beat up on President Bush here at The Liberty Papers, how confident would we be today about our 2nd Amendment rights had Al Gore or John Kerry appointed his choices for the Supreme Court? We may well have dodged a bullet in 2000.

Agreed...if we're looking for the best possibility of a pro-gun ownership verdict, now's as good a time as any to get it done. Ron Paul's still a longshot, the rest of the GOP slate is far from a lock and if Hillary does win in 2008 you can bet she's not going to be taking the pro-freedom side on this issue.

Stephen,

Seconded, though you have to admit that it's likely the best time for something like this to go through. With the Democrats looking likely to win the Presidency in 2008, I can't imagine a more favorable court anytime soon.
